BWACK Affiliate Program Terms, Conditions & Guidelines

1. Affiliate Terms & Conditions
1.1 Agreement to Terms
By joining the BWACK Influencer Affiliate Program ("Program"), you ("Affiliate") agree to be bound by these Terms and Conditions. This is a legally binding agreement between you and BWACK ("Company," "we," "us," or "our").
1.2 Affiliate Relationship
- You are an independent contractor, not an employee, partner, or agent of BWACK
- You have no authority to bind BWACK to any agreement
- You are responsible for your own taxes and business expenses
- This is a commission-based role only - no salary, hourly wage, or guaranteed income
1.3 Commission Structure
- Commission Rate: 20% of each sale (AUD $60 per AUD $300 product)
- Tracking: Sales tracked via unique affiliate links and cookies (30-day duration)
- Eligibility: Only sales made through your unique affiliate link are eligible for commission
- Hold Period: All commissions are held for 30 days after the drop ends to account for the refund/return window
- Payout Methods: PayPal or Bank Transfer (manual payouts processed after hold period)
- Minimum Payout: AUD $50
1.4 Prohibited Activities
Affiliates MUST NOT:
- Use deceptive, misleading, or false advertising
- Engage in spam (email, SMS, social media)
- Bid on BWACK brand keywords in paid search campaigns
- Create fake reviews or testimonials
- Impersonate BWACK or claim official partnership without permission
- Use affiliate links on coupon/deal sites without prior approval
- Engage in trademark infringement or brand misrepresentation
- Use black-hat SEO tactics or bots to generate clicks
- Purchase products using your own affiliate link
1.5 Termination
We reserve the right to terminate your affiliate status immediately if you violate these terms, engage in fraudulent activity, damage BWACK's reputation, or fail to comply with FTC requirements.
Upon termination: Access to your dashboard will be revoked, unpaid commissions may be forfeited, and you must cease all promotional activities immediately.
1.6 Returns & Refunds
- Customers have a 30-day return/refund window
- If a customer returns a product, the associated commission will be reversed
- This is why commissions are held for 30 days after each drop
2. Privacy Policy for Affiliates
2.1 Information We Collect
When you join the Program, we collect:
- Personal Information: Name, email address, PayPal/bank details (for payouts)
- Performance Data: Clicks, conversions, sales, commission earnings
- Tax Information: Required for 1099/tax reporting (if applicable)
2.2 How We Use Your Information
- Process commission payouts
- Provide dashboard access and performance analytics
- Communicate program updates, drop reminders, and marketing materials
- Comply with legal and tax obligations
2.3 Customer Privacy Protection
You will NOT receive: Customer names, email addresses, or phone numbers. You will only see aggregate referral counts in your dashboard to protect customer privacy.
2.4 Cookies
We use cookies to track affiliate referrals (30-day duration). By participating, you consent to cookie tracking.

3.2 Messaging Guidelines
✅ DO
- Be direct and honest
- Focus on quality and craftsmanship
- Mention limited availability (48-hour drops)
- Use authentic, personal voice
❌ DON'T
- Use excessive exclamation marks or caps
- Make exaggerated claims ("BEST EVER!!!")
- Use clickbait or misleading headlines
- Over-promise or create false urgency
3.3 Content Examples
✅ Good Example:
"The BWACK Code just dropped. Premium OG Bwack Hoodie, 48 hours only. Link in bio."
❌ Bad Example:
"OMG YOU NEED THIS NOW!!! CRAZY SALE!!! LIMITED TIME!!!"
4. FTC Compliance & Disclosure Requirements
⚠️ REQUIRED BY LAW
You MUST comply with FTC guidelines by clearly disclosing your affiliate relationship when promoting BWACK products. Failure to disclose may result in immediate termination and commission forfeiture.
4.1 Required Disclosures
- Use hashtags like
#ad,#affiliate, or#sponsoredin social media posts - Place disclosures prominently and before the call-to-action
- Verbal disclosures required in video/audio content
4.2 Platform-Specific Requirements
Instagram/TikTok:
- Use platform's "Paid Partnership" tag when available
- Include #ad or #affiliate in caption (not just comments)
- Place disclosure at the beginning of caption
YouTube:
- Verbal disclosure in video ("This video contains affiliate links")
- Written disclosure in description (above the fold)
- Use YouTube's "Includes Paid Promotion" checkbox
Twitter/X:
- Include #ad in tweet (not just thread)
- Disclosure must be in same tweet as affiliate link
4.3 Example Disclosure
"This post contains affiliate links. I may earn a commission if you purchase through my link at no extra cost to you. #affiliate"
5. Payment Terms
5.1 Payment Schedule
- Drop occurs (48-hour window)
- Drop ends → 30-day hold period begins
- After 30 days → Refund window closes
- Payout processed → Manual payout via PayPal or Bank Transfer (5-7 business days)
5.2 Tax Responsibility
You are responsible for reporting and paying all applicable taxes. BWACK may issue 1099 forms (US affiliates) or equivalent tax documents. Consult a tax professional for guidance.
